EB-5 Reauthorization After the Midterms: Why a Democratic Congress Could Secure the Program’s Future

Democrats won control of the House and Senate in the 2026 midterm elections. Here is what a Democratic Congress means for EB-5 reauthorization before the September 30, 2027 sunset, from rural set-asides and investor protections to the Gold Card debate

We’ve all heard of an October surprise. This week brought a November surprise: in the 2026 midterm elections, American voters gave Democrats control of both the House and the Senate.

So what does a Democratic Congress mean for the future of the EB-5 Immigrant Investor Program? In short, it raises the odds that this visa pathway will be extended. Democrats are unlikely to end a program that brings billions of dollars into the U.S. economy at zero cost to taxpayers.

The numbers make that case. An economic impact study commissioned by IIUSA and conducted by Fourth Economy found that between 2016 and 2019, EB-5 attracted $75 billion in private investment, created 1.7 million U.S. jobs, paid $122 billion in wages to American workers, contributed $184 billion to U.S. GDP and generated $14.5 billion in tax revenue.

A Democratic-led Congress, which will be sworn in on January 3, 2027, is also likely to run the program under a tighter regulatory lens. Expect more emphasis on rural investment, investor protections and accountability for local job creation.

Reauthorization will still need bipartisan support. With 54 Senate seats, Democrats remain short of the 60 votes needed to overcome a filibuster, and any bill still needs the President’s signature. EB-5 has a track record here: the EB-5 Reform and Integrity Act of 2022 passed with support from both parties. But a Democratic House and Senate will bring their own legislative and oversight priorities to the table. Here are four areas where we could see shifts from the current Congress.

1. Rural EB-5 and Targeted Employment Areas Become a Higher Priority

Democrats have historically pushed to make sure EB-5 capital goes where it is needed most. Under a Democratic majority, expect:

  1. Protection of the RIA set-asides. Strong defense of the visa reservations created by the 2022 Reform and Integrity Act (RIA): 20% for rural projects, 10% for high-unemployment areas and 2% for infrastructure projects.
  2. Stricter TEA definitions. Efforts to limit the “gerrymandering” of urban Targeted Employment Areas (TEAs), so that projects in affluent commercial districts cannot easily qualify for the lower $800,000 investment level meant for distressed communities.

For investors, this points in one direction: rural EB-5 projects are likely to remain the most protected part of the program.

2. More Oversight and Stronger Fraud Prevention

Democratic leadership has historically focused on worker protection and corporate transparency. Investors can expect:

  1. Support for EB-5 integrity rules. Backing for the Department of Homeland Security’s (DHS) July 2, 2026 proposed rule on regional center termination and automatic petition revocation, which aims to protect good-faith foreign investors from fraudulent or non-compliant operators.
  2. Job creation quality audits. Closer scrutiny of whether projects create legitimate, long-term, living-wage jobs for U.S. workers.

3. EB-5 Reauthorization as Part of Broader Immigration Reform

A Democratic majority changes the legislative strategy ahead of the EB-5 Regional Center Program’s September 30, 2027 sunset date.

  1. The comprehensive reform strategy. Democrats often prefer to pair popular, economically beneficial programs like EB-5 with broader immigration priorities, such as reducing long backlogs for skilled workers (H-1B and EB-2) or expanding paths to legal residency.
  2. Friction over derivative visa relief. The EB-5 industry has lobbied hard to stop dependent family members (known as derivatives) from counting toward the roughly 10,000 annual EB-5 visas. Some Democrats see granting that relief to investors, before resolving backlogs in family-sponsored and lower-income visa categories, as an equity issue.

4. No Pay-for-Residency Visa Without Job Creation

A Democratic majority also acts as a legislative buffer against alternatives to EB-5, such as the administration’s “Gold Card” pay-for-residency visa. The Gold Card was launched by executive action and has not been written into law by Congress. With Democrats controlling both chambers, legislation that would replace EB-5 with a “pure” capital-for-residency program, without strict U.S. job creation requirements, is unlikely to advance.

What Investors Should Watch in 2027

As the 120th U.S. Congress convenes in early January, it will be important to follow developments closely. Historically, a Democratic-led Congress has meant stronger regulatory oversight, a focus on targeted economic equity and, most importantly, a tendency to fold EB-5 Regional Center Program reauthorization into larger, comprehensive immigration reform packages.

A new Congress may approach EB-5 differently, but the math favors reauthorization.

Quick Answers

Will a Democratic Congress end the EB-5 program?

Unlikely. EB-5 creates U.S. jobs and investment at no cost to taxpayers, and its 2022 reauthorization had bipartisan support.

When does the EB-5 Regional Center Program expire?

Its current authorization runs through September 30, 2027, unless Congress extends it.

Are rural EB-5 projects affected?

Rural set-asides are likely to be among the most strongly protected parts of the program under a Democratic majority.

Can the Gold Card replace EB-5?

Not without Congress. EB-5 is set by law, and a Democratic Congress is unlikely to pass a pay-for-residency visa without job creation requirements.
