Conditional Green Card → I-829 → Permanent Green Card

TL;DR

After I-526E approval and visa issuance, you receive a 2-year conditional green card. File I-829 in the 90 days before it expires to remove conditions.

EB-5 is a two-stage immigration benefit. The first stage is the conditional green card, valid for 2 years from issuance. Before it expires, you must file Form I-829 to remove conditions and convert to a 10-year permanent green card.

  • Conditional GC issued at consular processing or I-485 approval
  • I-829 filing window: 90 days before the conditional GC expires (2-year mark)
  • I-829 must show your $800K investment remained "at risk" and that 10 jobs were created (or are still in the process of being created)
  • I-829 adjudication has historically taken 2-3 years; USCIS is working on streamlining
  • While I-829 is pending, your conditional GC is automatically extended via I-797C receipt notice

After I-829 approval, you receive a 10-year permanent green card and can apply for naturalization 5 years after your conditional GC was issued.
