The countdown to the EB-5 program's most important deadline is well underway. Under the EB-5 Reform and Integrity Act of 2022 (RIA), September 30, 2026 is the grandfathering cutoff — the date by which a clean Form I-526E must be on file for your petition to keep being adjudicated under today's rules, even if the Regional Center Program later lapses or Congress changes the terms. That deadline creates a high-stakes dilemma for many investors: you want to lock in today's legal protections and the current $800,000 threshold, but your full capital is not yet liquid or ready to wire. Being short on immediate cash does not automatically disqualify you. Below is a practical roadmap for meeting the deadline while your capital catches up — along with the caveats that keep each strategy defensible.

1. Consider a Partial Filing With a Promissory Note

If your capital is tied up in illiquid assets — real estate, a business, or fixed-term holdings — one option is a partial cash contribution paired with a legally binding promissory note for the balance.

  • The mechanism. You deploy a portion of the $800,000 up front and sign a promissory note pledging the remainder within a strict, predefined timeline. How much must be wired at filing depends on what the specific regional center and its counsel will accept as a substantial, genuine commitment.
  • The at-risk standard. USCIS requires that your capital be "invested or actively in the process of investing," and that the full amount be genuinely at risk.   • Source of funds for the balance. You must trace the lawful origin of both the initial cash and the funds that will satisfy the note. 2. Bridge the Gap With an Asset-Backed Loan or Lawful Gift

If a partial filing carries more uncertainty than you are comfortable with, short-term financing can close the gap so that you file with the full amount committed.

  • Asset-backed and bridge loans. If you own real estate, securities, or company shares that take months to liquidate, a line of credit or bridge loan secured by those assets lets you deploy cash now and repay the loan once your primary assets sell. Loan proceeds are an accepted EB-5 capital source when the loan is properly documented.
  • Lawful gift funds. A family member with liquid capital can gift you the remaining balance. To satisfy source-of-funds requirements, the donor must document how they lawfully acquired that money. You can later liquidate your own assets on your own timeline, outside the EB-5 filing.

3. Choose a Project — and a Regional Center — Built for This

Not every project or regional center is equipped for partial investors or complex funding timelines. The project you pick directly affects how much filing risk you carry into the deadline.

4. Start Now — Preparation Takes Weeks, Not Days

The single biggest threat to the September 30, 2026 deadline is assuming that filing is instantaneous. It is not.
